Shoosmiths Serious Injury, who are representing many of the affected former patients in medical negligence claims, have also found that in some cases where patients received recall outcome letters indicating no harm, subsequent independent expert evidence has revealed there was significant harm caused by Mr Shah's care.
Many of the patients identified in the report were treated as long ago as 2010. Although, it is more than three years since their treatment they may still be in time to investigate a potential claim, and we urge anyone in this situation to take legal advice.
Medical negligence specialist Nick Tubb, Partner, comments: “The Trust’s report refers to a complaint to the GMC in 2019 as being one of the key events leading to the eventual suspension of Mr Shah in 2021. When I acted for Joanne Aldridge in 2016 in her successful claim against Mr Shah relating to surgery in 2010, we made a complaint to the GMC. This was three years earlier than the complaint referenced in the report, but our complaint was rejected. This was a missed opportunity to act earlier which could have prevented injuries to more patients.”
