Shoosmiths have been progressing numerous applications to the fund and Becca Horley, clinical negligence solicitor in our Birmingham office, has recently advised on their first settlement sum. The settlement figure will include compensation for the pain, loss and suffering attributed to an unnecessary lumpectomy under general anaesthetic. Our Client will also be awarded compensation for the cost of the unnecessary procedure, care and travel.
Becca says: “Submitting a claim to the fund is quicker than progressing a claim through the traditional litigation route. The application process aims to settle these claims as quickly as possible and provide closure for patients treated by Mr Paterson some of whom suffered their unnecessary and inappropriate treatment as early as 1997”.
A Shoosmiths client has commented that the process was re-assuring and she now feels that Mr Paterson has been bought to account for the unnecessary treatment she suffered. The client said Shoosmiths were caring, understanding and looked after best her interests.
From December 2020 onwards, patients of Mr Paterson have been contacted and those who were not recalled previously were invited to discuss their treatment with an independent medical consultant and a Spire Healthcare case handler. Following the discussions, Spire Healthcare have been sending out a final outcome letter to each patient with the outcome of their review in writing. Unfortunately, a high number of patients have been informed that their treatment was unnecessary and inappropriate. Patient reviews are currently ongoing.
Shoosmiths Serious Injury have been instructed by over 50 patients treated by Ian Paterson so far in relation to the second compensation fund. The fund has been set up by Spire Healthcare to compensate patients who have undergone unnecessary treatment.
