Our client was travelling as a rear seat passenger in a vehicle when a car traveling in the opposite direction swerved into their path and smashed into their car at speed, forcing them off the road.
As a result, our elderly client sustained an injury to her coccyx, multiple rib fractures, a soft tissue injury to her right wrist and lacerations to both legs which required skin grafts. Her multiple injuries were extensive, so Shoosmiths sought interim payments to fund any treatment she required without delay.
She had employed a gardener and a cleaner since she could no longer carry out those tasks, but as an elderly lady with minimal income, she struggled to pay these costs. We also managed to obtain interim payments throughout the claim amounting to £3,500 to pay for these services.
The medical evidence obtained not only allowed us to seek the right early and ongoing treatment she required but also enabled us to accurately value her claim by establishing what she could and could not do going forward. Accordingly the claim included the costs of gardening and cleaning, travel expenses to medical appointments and building a path and patio for easier access to her garden.
The settlement of £43,500 achieved without the need to go to trial also included a sum to cover the damage to her clothing and personal property in the original accident as well as all her future financial expenses.
